Product Warranty: Limitation of Claims
Any product sold as used is not subject to any warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose. Any product sold as new is warranted to be merchantable. In the event of any product defect in a new product, Seller shall replace the defective product or refund the cost of the product, at Seller's option. By purchasing products from Seller, Buyer accepts this warranty and waives any claims other than as provided for in this warranty, including waiving any claims for lost profits or consequential damages. In the event there is any claim arising out of breach of this warranty, Buyer agrees:

1. The terms of the purchase and the Return Policy will be construed according to the laws of the State of Arizona;

2. Any legal action will be brought and enforced in the state or federal courts located in Maricopa County, Arizona; and,

3. The party prevailing in any legal action shall be awarded its reasonable attorney's fees and costs, in addition to any other rights or remedies to which it may be entitled.
